1. Acknowledgment of Inherent Risk
I acknowledge that Brazilian Jiu Jitsu (BJJ), martial arts training, self-defense instruction, grappling, sparring, drilling, strength and conditioning, and all related activities (collectively, “Activities”) are inherently dangerous.

I understand that participation involves significant risks, including but not limited to:

• Physical injury (minor and severe)

• Permanent disability or paralysis

• Concussion and traumatic brain injury

• Illness or infection (including communicable diseases)

• Death

These risks may result from my own actions or inactions, those of others, the condition of the premises, or the negligence of SOKY Brazilian Jiu Jitsu.

2. Voluntary Participation
I voluntarily elect to participate in the Activities and accept full responsibility for my participation and any resulting injury or damage.

3. Assumption of Risk
I knowingly and freely assume all risks, both known and unknown, foreseeable and unforeseeable, even if arising from the negligence of SOKY Brazilian Jiu Jitsu, its owners, officers, instructors, employees, agents, independent contractors, volunteers, members, or other participants (collectively, “Released Parties”).

4. Release and Waiver of Liability
To the fullest extent permitted by Kentucky law, I hereby release, waive, and discharge the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, whether known or unknown, arising out of or related to my participation in the Activities. This release includes, without limitation, claims based on the alleged negligence of the Released Parties. I understand that this waiver does not apply to gross negligence or willful misconduct to the extent such limitation is prohibited by law.

5. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

• My participation in the Activities

• My actions or omissions

• Any damage or injury caused by me to others or property

6. Medical Representation and Fitness
I represent and warrant that I am physically fit to participate and have no medical condition that would increase my risk of injury.
I agree to:

• Inform instructors of any injuries or medical conditions

• Cease participation if I feel unsafe, injured, or unwell

7. Safety Compliance and Conduct
I agree to follow all gym rules, safety protocols, and instructor directions at all times, including:

• Tapping early and respecting training partners

• Maintaining control during all training

• Using proper technique and equipment

• Practicing appropriate hygiene

I understand that failure to comply may result in immediate removal from participation without refund.

8. Hygiene and Communicable Disease Acknowledgment
I acknowledge the risk of exposure to bacteria, viruses, and other pathogens, including skin infections common in contact sports.
I agree not to participate if I have:

• Open wounds or untreated skin conditions

• Contagious illness or infection

9. Emergency Medical Authorization
I authorize SOKY Brazilian Jiu Jitsu to obtain emergency medical treatment on my behalf if necessary.
I accept full financial responsibility for any medical care provided.

10. Photo and Media Release
I grant permission for SOKY Brazilian Jiu Jitsu to use my image, likeness, or voice in photographs or videos for promotional purposes.

11. Minors (If Applicable)

I am the parent or legal guardian of the minor participant. I consent to their participation and agree to all terms of this agreement on their behalf.

I further agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor.

12. Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky. Any legal action shall be brought exclusively in a court of competent jurisdiction within Kentucky.

14. Acknowledgment of Understanding
I acknowledge that:

• I fully understand its terms

• I understand that I am waiving significant legal rights, including the right to sue
